1. Acceptance of these Terms
These Terms of Service ("Terms") govern the use of GameItemShop, a platform that allows private game server operators ("you", "the Merchant") to create online shops to sell items, virtual currency and VIP ranks from their server ("the Service"), operated by GameItemShop ("GameItemShop", "we"), with registered address at United States.
By creating an account or using the Service, you accept these Terms in full. If you do not agree, you must not use the Service.
2. Description of the Service
GameItemShop provides a dashboard to create and manage one or more online shops ("Shops"), each accessible at its own URL under shop.gameitemshop.com. The Service includes: catalog, category and promotion management; integration with external payment processors (Stripe, PayPal and/or e-Payouts, depending on which you enable); automatic or manual delivery of purchases; and sales statistics.
The Service is offered under plans with different limits and features (Free, Pro, Enterprise), detailed on our Pricing page. We reserve the right to modify the features of each plan, with reasonable prior notice for changes that reduce features you already have.
3. Eligibility and account registration
- You must be at least 18 years old, or the legal age of majority in your country, to create an account.
- The information you provide (name, email) must be accurate and kept up to date.
- You are responsible for keeping your password confidential and for all activity on your account.
- Creating multiple accounts to bypass plan limits or abuse promotions is not allowed.
4. Your responsibility as a Merchant
You are solely responsible for:
- The content of your Shop (item names, descriptions and images), including that it does not infringe third-party rights or applicable law.
- Ensuring your private server and the sale of virtual items comply with the original game's Terms of Service and with the laws applicable to you and your buyers.
- Correctly delivering what your buyers pay for (automatically, if you integrated your database, or manually).
- Handling claims, inquiries and refund requests from your own buyers. GameItemShop is not a party to the sales relationship between you and your customers.
- Your tax obligations on the income you generate through the platform.
GameItemShop does not control or guarantee the content of Shops created by Merchants and may remove it or suspend a Shop that violates these Terms.
5. Prohibited uses
You may not use the Service to:
- Sell illegal, fraudulent, defamatory content or content that infringes third-party intellectual property.
- Process payments that do not correspond to a real sale (money laundering, stolen card testing, etc.).
- Attempt to breach the security of the platform, other Shops, or the integrated payment gateways.
- Any activity that violates applicable law.
Detection of these uses may result in immediate account suspension, without refund of amounts already paid for the plan.
6. Payments and plans
Paid plans (Pro, Enterprise) are billed according to the chosen method: recurring monthly subscription (via Stripe or PayPal) or a one-time payment for a fixed period of 1, 3, 6 or 12 months (via e-Payouts, with no auto-renewal). Current prices are shown on the Pricing page before confirming any payment. GameItemShop does not charge any commission on the sales you make in your Shop: the only charge is your subscription plan.
Recurring subscriptions renew automatically until you cancel them from the Billing section of the dashboard. You can cancel at any time; cancellation applies from the next billing cycle (no pro-rated refund of the period already started, unless applicable law requires otherwise).
If you downgrade to a plan with lower limits (for example, from Pro to Free), Shops or items exceeding the new limit are automatically disabled (not deleted) and stop being visible until you return to a plan that includes them.
7. Third-party payment processors
GameItemShop does not process or store card numbers or banking credentials. All payments (both what you charge your buyers and what you pay GameItemShop for your plan) are processed by external providers: Stripe, PayPal and/or e-Payouts, depending on which you enable. Use of these processors is subject to their own terms and privacy policies. GameItemShop is not responsible for outages, account rejections or settlement delays attributable to these third parties.
8. Refunds
For payments made with Stripe or PayPal through the dashboard, refunds of your platform subscription can be managed from Billing where applicable. For payments made with e-Payouts, refunds must be requested manually from their support.
Refunds to YOUR buyers for items purchased in your Shop are your responsibility as the Merchant; the platform provides the technical tool to execute them (automatic refund via Stripe/PayPal, or manual request via e-Payouts) but the decision to refund is yours.
9. Intellectual property
The software, design, brand and features of GameItemShop are the property of GameItemShop. You retain all rights to the content you upload to your Shop (names, descriptions, images), and grant us a limited license to store and display it as part of operating the Service.
10. Service availability and disclaimers
The Service is provided "as is", without guarantees of uninterrupted availability. We make reasonable efforts to keep the Service operational, but do not guarantee it will be free of errors or interruptions. We are not liable for losses arising from your own game server going down, errors in your database integration, or failures of third-party payment processors.
11. Limitation of liability
To the maximum extent permitted by applicable law, GameItemShop will not be liable for indirect, incidental, special or consequential damages (including loss of profits or data) arising from use of the Service. Our total liability for any claim will not exceed the amount you paid for the Service in the three (3) months prior to the event giving rise to the claim.
12. Suspension and termination
We may suspend or terminate your account, with or without prior notice, if you breach these Terms, if we detect fraudulent activity, or upon legal requirement. You can cancel your account at any time from the dashboard. Cancellation does not release you from payment obligations already incurred.
13. Changes to these Terms
We may update these Terms periodically. Substantial changes will be notified by email or via a notice on the dashboard with reasonable advance notice. Continued use of the Service after an update constitutes acceptance of the new Terms.
14. Governing law
These Terms are governed by the laws of United States, whose courts will have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights granted by the law of your country of residence.
